Is Sprinkles Cupcakes bullying copycat cupcakeries?

Sprinkles Cupcakes suing rival copycatsFed up with rivals who are copying its signature look, Sprinkles Cupcakes is fighting back.

The notoriously popular Beverly Hills-based cupcake chain is suing independent treat shops for allegedly stealing Sprinkles’ trademark look, according to recent reports in the Los Angeles Times.

Sprinkles officials have declined to comment on the lawsuits. But, clearly they’re going after any copycat. The chain, which is set to open a new cupcakery in Palo Alto, is suing Sprinkled Pink Cupcake Couture in Montecito and Famous Cupcakes in North Hollywood, according to the L.A. So, far no word of any Orange County cupcakeries getting hit. Still, watch your back. Sprinkles’ legal team told the Times that the chain’s signature “dot,” and its trademark name, are the chain’s meal ticket and it will do whatever it takes, legally, to protect it.

In fact, Sprinkles is now addressing itself in press kits as “The Original Cupcake Bakery.”

Anyone who’s been to Magnolia Bakery in New York City knows that is not a valid claim. Yes, Magnolia sells cakes, but it is known for its cupcakes.

    a cupcake is not a cupcake..
    Trust me, I make them and get paid to make them.

    I could make an ugly dry cupcake with no flavor- OR, i could spend more time and quality ingredients and make a pretty, TASTY cupcake.

    Dana, glad you’re able to make a living, but a cupcake is a cupcake. If you choose to make it bad, that’s your choice, but fresh cupcakes only get so good…and NO cupcake is worth $3.50, unless she puts out.

    Look, there’s plenty of room in this world for a multitude of cupcake bakeries.

    That’s like Chili’s getting bent about TGI Fridays.

    Oh, and I’ll make my OWN cupcakes for less than $3.50 a piece and they’ll tast a WHOLE lot better.

    Get over your dang self, Sprinkles.

    These cupcake shops will be out of business in a year or so! YOu could buy a box of mix and frosting and make 3times as many as two of these things cost.

    My Fianc’e owns Essential Chocolate Bakery in Culver City and took 3rd place in the overall Cupcake Challenge earlier this year in Pasadena. We are a full service bakery open for more than a decade selling a lot more than cupcakes! We go arround to other bakeries to figure out what works and what does’nt. Like in any business certain trademarks are important so that your product is recognized in the outside world compared to the many others. For example, when we go out for dinner she can tell that the dessert the restaurant claims that they made was actually made by a major foodservice bakery like La Mouse or can tell who made a wedding cake by the way it looks. We too have our items that are distinctively ours and are trademarked like our heart shaped blueberry scones or Jumbo sized Cupcakes that are almost twice the size as a sprinkles but are sold at about the same price. It’s important to protect your trademark and be aggressive with it BUT you know you have a good thing when others want to copy you. Question is though… Who was truly first? Maybe it was Mom who baked them for her kids to take to school for their birthday, oh wait a seccond you can’t do that now a days can you.
